Kanadalı kripto para alım-satım platformu ezBtc ve kurucusu David Smillie, yaklaşık 13 milyon Kanada doları (9.5 milyon ABD doları) değerindeki müşteri kripto yatırımlarını kötüye kullanarak dolandırıcılık yaptı ve bu fonları kumarda kullandı.

Kanada‘nın bir eyalet düzenleyicisi olan British Columbia Menkul Kıymetler Komisyonu (BCSC) tarafından oluşturulan bir panel, ezBtc‘nin müşteri fonlarını “kişisel amaçları için” kötüye kullandığını ortaya koydu.

Eylül 2019 civarında tamamen kapanan ve 2022’de tasfiye edilen ezBtc platformu, kullanıcılarının kripto yatırımlarını soğuk cüzdanlarda sakladığını iddia ediyordu.

2016 ile 2019 yılları arasında faaliyet gösterdiği süre boyunca ezBtc, kripto yatırımcılardan 2,300’ün üzerinde Bitcoin ve 600’ün üzerinde Ether topladı.

EzBtc, 935.46 Bitcoin ve 159 Ether‘i kişisel kullanım ve kumar için yönlendirdi BCSC paneline göre, Smillie, kullanıcıların fonlarının yaklaşık üçte birini kumar ve kişisel kullanım için yönlendirdi:

“Toplamda, ezBtc tarafından 935.46 Bitcoin ve 159 Ether, Smillie’nin borsa hesaplarına ve/veya CloudBet ve FortuneJack‘e transfer edilmiştir. Kumar sitelerine yapılan transferler bazen doğrudan ezBtc‘den, bazen ise ezBtc‘den Smillie’nin borsa hesaplarına ve ardından kumar sitelerine yapılmıştır.”

Panel, Smillie ve ezBtc tarafından düzenlenen “aldatmanın” müşteri varlıklarının çekilememesi nedeniyle “gerçek kayıplara” yol açtığını belirtti.

Mahkeme dosyasına göre, 24 Eylül’e kadar yaptırımlar uygulanacak ve bu yaptırımlar parasal cezalar veya piyasa katılım yasağı gibi çeşitli şekillerde olabilir.

Smillie ve ezBtc temsilcileri duruşmaya şahsen katılmadı, ancak kurucu bir avukat tarafından temsil edildi.
