FTX Mahkeme kararı

Çökmüş kripto para borsası FTX ve kripto para firması Alameda Research, bir New York hakiminin Çarşamba günü mutabakat emrini resmi olarak onaylamasının ardından alacaklılara 12.7 milyar dolar ödeyecek. Bu karar, Emtia Vadeli İşlemler Komisyonu’nun (CFTC) açtığı 20 ay süren davayı sonlandırıyor.

ABD Bölge Hakimi Peter Castel, onayı 7 Ağustos’ta verdi. Dava, kişilere para cezası talep etmedi.

Emir, FTX ve kripto piyasasında büyük bir oyuncu olan kardeş kuruluş Alameda‘nın dijital varlık ticareti yapmasını ve piyasa aracısı olarak hareket etmesini yasaklıyor; ancak kişisel cezalara yer vermiyor.

FTX, 2022’nin sonlarında iflas başvurusu yaparak yatırımcıların milyarlarca dolarlık varlığını yok etti. Bunun ardından, CFTC, FTX ve Alameda‘ya karşı dava açtı ve her iki firmanın da FTX‘i dijital emtia varlık platformu olarak tanıtarak dolandırıcılık ve yanlış beyanlarda bulunduğunu iddia etti.

Her iki şirketi de kuran Sam Bankman-Fried, Mart ayında 25 yıl hapis cezasına çarptırıldı ve 11 milyar doları müsadere etmeye karar verildi. Bankman-Fried, daha önce yedi adet dolandırıcılık, komplo ve kara para aklama suçundan mahkum edilmişti.
